BAKERSFIELD, Calif. (KBAK/KBFX) - A man is going free Thursday, the same day he was sentenced on a voluntary manslaughter plea in the death of a 2-year-old boy.

Joshuae Preston was accused of beating his then-girlfriend's son, Guillermo Alvarez, to death in June 2009. He was arrested soon after the death and charged with murder, but the case was dismissed when pathological exam results didn't come back in time.

Preston was babysitting Gina Serna's five children when he called 911 about Guillermo being unresponsive. Doctors reported the boy had bruising on his jaw, collar bone area and stomach, among other reported injuries.

A public defender at Thursday's sentencing claimed Guillermo died of a disease, specifically a blood disorder.

Preston was sentenced to three years in prison but will be released because of time served. He entered his plea deal last month in Kern County court.
