Gun ban wouldn't sit well with Kern County sheriff

BAKERSFIELD, Calif. (KBAK/KBFX) — You can add Kern County Sheriff Donny Youngblood to the list of law enforcement officials who say they will not enforce any laws that ban assault weapons.
"If the federal government banned all these weapons and then wanted us to come over with them to start seizing weapons, the answer is 'no,'" said Youngblood during an interview in his office.
No such laws have yet been approved by Congress. But, there is proposed legislation that makes more than 150 weapons illegal, including assault weapons and ammo magazines holding more than 10 rounds.
Youngblood is among a group of sheriff's that will be meeting with federal law enforcement officials in Washington D.C. to talk about pertinent issues. Youngblood said he wants to hear more about any proposed plan for gun control, as well as to let the federal government know that he is opposed to gun control.
"I think the Second Amendment gives us the right to have firearms to protect ourselves and our families," said Youngblood.

i live in los angeles county and work in a federal facility, but i am a staunch believer and supporter of the second amendment and know how you and most of your honorable colleagues stand, but our sheriff here is retarded (my opinion). your point and so many others is that you will not enforce emperor barack hussein ( still don'r know how some one with a terrorist sounding name gaot elected) obama's gun ban regulations, but are you and your fellow sheriffs going to do anything to stop it, because it will be a bloodbath and this is what liberals want. i think true americans, not african americans, not mexican americans, not asian americans, but true americans have had enough. i am an naturalized american of asian decent...i am not asian americam, i am american and do not have dual citizenship. i owe my allegiance only to one flag and the constitution and people of america. if i have to die for that stand so be it, but i came here to savour true freedom and nobody not anyone is going to take that away from me and those who stand by my beliefs.

Dana Dale: I think the sheriff's oath of office is the whole point! The Constitution of the United States is the supreme law of the land and it can not be superseded by statutory law!! What the sheriff is saying is that he is going to uphold the oath that he and every peace officer takes to protect and defend the constitution against all enemies, foreign or domestic. Do you know that almost 100% of the sheriffs in some other states have made similar statements to what Sheriff Youngblood has said. I for one applaud his courageous public statement.
Thank you Sheriff! Thank you for not being a traitor to the citizens to whom you protect, like Police Commissioner Ramsey of Philadelphia. You understand what is going on, and what the real world repercussions would be if these proposals become law, and only the criminals are armed.

 No law shall make me give up the right to defend myself with as much force as reasonably allowed  You can have my guns when you pry them from my cold dead fingers, but always remember I didnt attack you you attacked me and I will defend myself from an aggressor even if that aggressor thinks they have the right to take my guns, you dont.

I do not think that if the federal government passes a law banning weapons that they have the ability to enforce that law without local law enforcments putting their lives on the line which i dont want them to because if the feds want the guns the feds can come risk getting shot to get them.Im living proof of the failure of legislation when our elected represintitves pass laws that cannot be enforced like the "No Child left behind act" which crippled schools and cause way more problems than their worth.

The Second Amendment was written in 1791, 15-years after the war of Independence from the British.
There was no organized militia back then. The weapons back then were Muskets. Â Twenty years later came the War of 1812 against the British. The Second Amendment was to protect the colonies against the British invaders.

Today, we want to uphold the same status quo, only now with rapid-fire assault weapons. Many of these weapons are falling into the wrong hands.

@life's a charge When the 2nd Amendment was ratified in 1791, muskets were the military arms of the day. The reason our Founders included it in our Bill of Rights was to have the ability to protect ourselves from another tyrant having rule over us.
Now, the average citizen cannot get an assault weapon. The closest thing we can get is a semi-automatic rifle that is made to look like an assault weapon, which is a fully-automatic weapon. The two guns operate as differently as a Corvette and a Cobalt., they both have an engine and 4 wheels, but perform at a much different level, just as a civilian AR15 and military M16 have similarities but very different capabilities.
What makes me mad is that whole shooting event at the Sandy Hook school did not involve an AR-15 Bushmaster rifle at all. The kid stole it, had it in the car, but used handguns he stole from his mother after he brutally murdered her...tell me this should not be more about helping the "mentally disturbed" then threatening to take away "Legal" firearms? This is a gun grab by the left wing anti-gun lobby, getting paid back for the $Millions in contributions to Feinstein and the Obama campains over the years. They want payback and they are making up one lie after another to cover the fact that no such weapon was even used to shoot those children.
The Second Amendment gives us the right to have weapons to DEFEND ourselves and families.  DEFENSE has NEVER been the purpose of ASSAULT weapons.  It's right there in their name!!!!!  Can Sheriff Youngblood not see the difference?

The problem is that people like YOU do not understand what these law makers have used to declare them "assault weapons". Can YOU tell me why a pistol grip makes a rifle makes it more dangerous to the public? What about a forward pistol grip; or a flash hider? And the 2nd Amendment does not only give us the right to bear arms to protect ourselves, but to be able to fight against a tyrannical government. Remember, our founding fathers wrote this stuff, not me. And even though it was a long time ago, these were extremely intelligent men. They saw the future and wrote the Constitution and the Amendments accordingly. They have always been referred to as great American patriots. They wanted freedom and liberty and they fought for it and won. After that, they gave us the freedoms we have today, and now we have to fight to keep them!

Lets see if you can understand this...when you go to the fashion outlets and buy a "knock off" of a Coach Purse, well that's what AR-15's are, they are not the real thing, they just look like it. The anti gun lobby came up with the term "assault weapon" to make our standard "legal" firearms sound worse than they are. In California you are only allowed to have a magazine with 10 rounds in it now, so all they will do is try to modify the law to make the "legal" semi-auto rifle illeagle.
  Difference between an M-16 or M-4 the military uses and an AR-15 is the military versions have "Burst Mode".  Meaning a 3 round burst.  AR-15 is essentially the same as an M-16 but it does not have the burst mode. Â
While I commend him for taking a stand, it's his job to enforce the laws, not to make laws or interpret laws. Â Law enforcement has no authority to declare a law unconstitutional. Â If he wants to do that, he should become a judge.

 @JimBut the president and the congress do not make a law constitutional either. Remember, even if the judicial system were to allow gun bans, the 2nd Amendment was written to give the public the ability to fight governmental tyranny, and the first step to tyranny is to dis-arm the public, that allows those who are supposed to be public servants to become rulers. If government fails us it is up to the people to fight back, our Sheriff is on the side of the people, he knows his place.

The sheriff's job is to uphold, protect, Â and support the US Constitution. Not to enforce laws. It is in the OATH he takes, upon entering office. Do some homework, beforeyo u post a comment. It may just keep you from looking stupid!

The sheriff's job is to enforce the laws, not to make the laws or select the ones he likes or doesn't like. Â If Sheriff Youngblood no longer wants to do his job, maybe it is time for a new sheriff.

 @dumpsterfire the sheriff's main job is to uphold the US Constitution. If a law is unconstitutional, it is the sheriff's job to NOT obey that law. That is whay, when you take an oath like he took, it states to uphold all LEGAL laws. Just because some idiot decides to declare something a law, does not MAKE it a Constitutional law.Â

@dumpsterfire ok, last time I checked the Supreme Court has several resent decisions that reinforce Sheriff Youngblod's position. Maybe you need to address your comments to our California Senators. If they don't like the 2nd amendment then amend it! There are constitutional provisions for doing this, and at least that would be legal.
