DELANO, Calif. (KBAK/KBFX) — Two medicinal marijuana dispensaries in Delano have been operating for months, apparently without the knowledge of city officials. But what concerns one resident the most is the location of the dispensaries.

"I have concerns because of the clientele more than anything," said Mike Gutierrez, director of the Delano Association for the Developmentally Disabled, or DADD.

Gutierrez said he had no qualms over the issue of medical marijuana, but the people who frequent the shops nearby have at times been rude and made obscene gestures. He said it's not good for business.

The two dispensaries are located next to each other on the corner of 6th and Main streets. One is called Icky Sticky Cooperative, and its next-door neighbor is Mother Nature Incorporated.

Right across the street is DADD, which also houses a day care center for adults.

Down the street, on the corner of 5th and Main, is a church, Iglesia La Vida.

When Eyewitness News asked if the dispensaries had a business license, city officials said none had been issued. We asked if the dispensaries can be located across the street from a day care or near a church?

According to an ordinance adopted by the city in 2006: "The city has not adopted rules and regulations applicable to the location and operation of medical marijuana dispensaries."

When we asked city and police about these two dispensaries, we were told they were unaware the dispensaries existed.

"It would be very difficult for me to believe that the law enforcement agency of this community is not aware of the two facilities," said Gutierrez.

Police said they plan on sending a code enforcement officer to inspect the two dispensaries for compliance with a business license.

And the city also plans on reviewing the issue and address the matter of where medical marijuana dispensaries can be located.
