BAKERSFIELD, Calif. (KBAK/KBFX) - The lawsuit brought by the family of ex-NFL player David Lee "Deacon" Turner has been settled for $1.8 million.

The wrongful death suit was filed in federal court after Turner was shot and killed July 10, 2011, during an altercation with Kern County Sheriff's deputies.

Brian Dunn, attorney for the family, said the agreement with Kern County was reached a couple weeks ago in an effort to avoid a retrial, and the agreement was probably officially recorded Friday.

The $1.8 million settlement is in exchange for full dismissal of all action in the case, according to Dunn, and each side will bare its own costs.

In March, the federal trial ended with a hung jury. The case was set to go to retrial later this year.
