Juror misconduct prompts mistrial in murder, rape case

BAKERSFIELD, Calif. -- A mistrial has been declared in the case of a man accused of raping and killing his niece.

Phillip Ellison allegedly raped and killed 14-year-old Jamesha Terry in 2008 near her California City home.

Opening arguments in the trial began last week, but the judge declared the mistrial Monday because of juror misconduct. The judge wouldn't say what the juror did to prompt his decision.

A new jury will be selected beginning later this week.
