BAKERSFIELD, Calif. (KBAK/KBFX) — Two wrongful death claims have now been filed against Kern County in the wake of a sheriff's deputy crash in Oildale.

Deputy John Swearengin was en route Dec. 16 to a report of a stolen vehicle with a suspect on the scene when his patrol car slammed into two pedestrians, 24-year-old Daniel Hiler and 30-year-old Chrystal Jolley, according to the sheriff's office.

The second wrongful death claim was filed Tuesday by attorney Steve Nichols on behalf of Jolley's family. The attorney on Wednesday shared surveillance video that shows Swearengin's patrol car just before the crash, allegedly speeding without the use of its emergency lights and sirens.

The California Highway Patrol, which is handling the investigation, hasn't said how fast Swearengin was driving.

The attorney accuses the deputy of driving with conscious disregard for the safety of the general public.

Hiler and Jolley, who were walking a small motorcycle across the street, weren't using a crosswalk when they were struck, according to the CHP.
