TEHACHAPI, Calif. (KBAK/KBFX) - Among concerns over budget, curriculum and extra curricular issues, the Tehachapi Unified School District unanimously approved a petition to open the Abernathy Collegiate Charter School.

"It's just a different choice, it's a choice of a smaller school environment," said petitioner Teresa Foley.

But the approval is subject to approval of a memorandum of understanding between the TUSD and Abernathy Collegiate Charter School. TUSD board members raised concerns over budget projections and extracurricular activities.

Also unresolved is whether the new charter school would be subject to the same federal mandate as TUSD to teach an anti-bullying curriculum that some parents oppose, claiming it promotes a gay agenda.

"We are working with the Office of Civil Rights right now. No decision has been made," said Foley.
