Dad, son won't face murder charges - at least for now

BAKERSFIELD, Calif. — The Kern County district attorney will not file murder charges – at least for now – against a father-son duo accused of shooting a man outside an east Bakersfield bar.

Deputy District Attorney Ken Russell said Monday that more investigation is needed before they can prosecute 41-year-old Mark Anthony Mendoza and 24-year-old Mark Mendoza Jr.

The men are accused of shooting 34-year-old Roman Fernandez just before 2 a.m. Aug. 21 in the parking lot of Stella's Sandtrap Lounge on Niles Street. Witnesses reported hearing a gunshot and seeing a dark-colored pickup leave the area at a high rate of speed.

The Kern County Sheriff's Office hasn't released a motive for the shooting.

The elder Mendoza remains jailed on a parole violation, but his son is likely to be released from custody.
