Witness video shows arrest of man who died in custody

BAKERSFIELD, Calif. (KBAK/KBFX) — Video was released Monday of a confrontation between Kern County deputies and a suspect who died in custody soon after that confrontation.

The sheriff's office responded May 7 on a public-intoxication call near Kern Medical Center. The sheriff's office said the target of that call, 33-year-old David Silva, became combative and resisted deputies, who used "baton strikes" to gain control of the situation.

Shortly after Silva was taken into custody, he developed breathing problems and died at KMC. The coroner's office said the cause-of-death determination is pending toxicology and microscopic studies.

A family leaving KMC said they witnessed the arrest and claim they observed deputies using excessive force.

The witnesses grabbed their cellphones and took video, which was released Monday by their attorney, Daniel Rodriguez.

"There's a man laying on the floor, and your police officers beat the (expletive) out of him and killed him," one of the witnesses, Sulina Quair, said in a call to 911 that night. "I have it all on video camera."

The newly released video was captured on a cellphone belonging to Francisco Arrieta. The disc containing the video was marked "Edited (Rotated)" and came from Aguero Investigations.
